TERMS AND CONDITIONS (GTC)


SCOPE

Unless expressly agreed otherwise, our terms and conditions apply to the business relationship between TINY BIRDS, Managing Director Mag. Angelika Gloning, with the company headquarters and business address: Eichenstrasse 15, 5081 Anif, and the customer. The customer agrees that in the case of the use of general terms and conditions by him, in case of doubt, our conditions are to be assumed. TINY BIRDS can change the terms and conditions at any time, so the version current at the time of the order applies. By submitting the order, the customer agrees to these General Terms and Conditions. The customer's order represents a binding offer. TINY BIRDS accepts the customer's offer by delivering the ordered goods. TINY BIRDS is entitled to refuse an order without giving reasons. Deviating conditions of the customer are not recognized unless TINY BIRDS expressly agrees to their validity.


OFFERS AND SPECIFICATIONS

The presentation of the products in the online shop does not represent a legally binding offer. Descriptions of services on individual websites of the seller do not have the character of an assurance or guarantee. All offers are valid while stocks last, unless otherwise noted on the products. Apart from that, errors remain reserved.The customer's order represents an offer to conclude a purchase contract. The order confirmation we subsequently send does not represent acceptance of the offer. The purchase contract is only concluded as soon as we deliver the ordered goods and confirm the shipment to the customer.

PAYMENT METHODS, PRICES AND SHIPPING COSTS

The purchase price is due upon conclusion of the contract. All goods remain the property of TINY BIRDS until full payment has been made. If third-party providers are commissioned to process payments, such as Paypal, their general terms and conditions apply. The delivered goods remain the property of TINY BIRDS until full payment has been made.All prices stated on the TINY BIRDS website are gross prices in euros and include all statutory taxes and duties for domestic deliveries. Any shipping costs will be shown separately and clearly communicated to the buyer during the ordering process.For deliveries outside of Austria, additional customs duties and/or duties may apply, including any import or export duties and any consumption taxes. Such duties and/or taxes shall be borne entirely by the buyer.The given prices are not binding. The prices for repeat orders are also non-binding. The binding prices are displayed in the online shop after the correct selection in the shopping cart.


DELIVERY TIME

The specified delivery times are to be understood as a guide and do not offer any guarantee that they can be met. If the ordered product is not available, the seller can withdraw from the contract. In this case, the seller will inform the customer immediately and, if necessary, propose the delivery of a comparable product. If no comparable product is available or the customer does not wish to have a comparable product delivered, the seller will immediately refund the purchase price to the customer.

RETURN OF GOODS AND RIGHT OF WITHDRAWAL

Consumers within the meaning of the Consumer Protection Act can withdraw from the purchase contract without giving reasons within fourteen working days (Monday to Friday) from the day the goods are received by the buyer, provided that the withdrawal is sent in a timely manner. Defects must be reported immediately after receipt of the goods. After checking, the goods will either be exchanged or the money will be refunded.In the event of withdrawal, the goods must be returned complete and in their original packaging, in an unused and new, resalable condition. The costs of returning the goods are to be borne by the buyer.The invoice amount to be refunded can be reduced accordingly by the seller if the items are affected by signs of use, are damaged or are incomplete. To protect the right of withdrawal, it is sufficient to send the declaration of withdrawal in good time, e.g. by letter or email to:

TINY BIRDS will not pay for the return shipping costs for the return or exchange of goods ordered from the web shop.
